PARKING RESTRICTONS

The Tamarac at Moon Valley community is governed by a Declaration of Covenants, Conditions and Restrictions (“CC&Rs”) and the Tamarac at Moon Valley Association (“Association”).  The purpose of this document is to clarify certain provisions of the CC&Rs and to set forth new Rules created by the Association’s Board of Directors governing parking in the community.

The Association is the owner of the streets in the community, and the streets are referred to as Common Area.  The streets are private for the use of owners, tenants and guests and are not open to the public.  Maintenance and upkeep of the streets is the responsibility of the Association and is paid for with the monthly fees collected from each property owner.  The Association is charged with enforcing all restrictions pertaining to parking and has the authority to create Rules governing the parking of vehicles.

Section 6.6, in part, states:

Vehicles.  Private, non-commercial, passenger automobiles or pickup trucks, which, when including all attachments (including, without limitations, racks and shells), do not exceed ¾ ton in carrying load or cargo capacity, seven (7) feet in height or eighteen (18) feet in length (“Allowed Vehicles”), shall be parked within a garage wherever and whenever such facility is sufficient to accommodate the number of vehicles on a Lot or shall be parked as allowed herein below.  No other vehicle (including but not limited to, mobile homes, motor homes (mini or standard size), boats, boat trailers, recreational vehicles, tent trailers, trailers, all terrain vehicles, buses, campers, camper shells, commercial vehicles, or vehicles exceeding ¾ ton in carrying load or cargo capacity, seven (7) feet in height or eighteen (18) feet in length) shall be kept, placed, or maintained upon the Property or any roadway adjacent thereto, except:  (a) completely parked or maintained within a garage; or (b) in such areas and subject to such rules and regulations as the Board may designate and adopt in its sole discretion (and the Board in its sole discretion may prohibit such other vehicles and equipment completely).

Pursuant to Section 6.6 all vehicles permitted by the CC&Rs are to be parked in garages.  Driveways in this community are too short for routine parking of a permitted vehicle and the Phoenix City Code (Section 36-134(1)) prohibits the parking of vehicles on a sidewalk.  It is further understood that routinely parking on the street is only allowed as described in the CC&Rs and parking restrictions are strictly enforced within the Tamarac at Moon Valley community.

GUESTS, VISITORS AND/OR INVITEES

Guests/visitors/invitees are allowed in Tamarac community in compliance with the following and all HOA CC&Rs, rules, policies and guidelines. A Guest (including visitor and invitee) is defined as a non-qualified homeowner or non-tenant of a qualified homeowner of the Tamarac HOA.  The homeowner/tenant associated with the Guest is responsible for sharing the CCR s with any Guest prior to the Guest parking in the HOA community.  If a Guest is noncompliant with the HOA CC&R, rules and regulations, the homeowner may be held accountable for any incurred fines and towing costs. 

Any Guest’s Allowed Vehicles parking on the street overnight must be pre-registered with Tamarac HOA under the homeowners’ address.  The pre-registration request may be obtained by the homeowner emailing the HOA at tamaracmoonvalley@gmail.com. The pre-registration request must include the name of the homeowner, name of the Guest, the vehicle make/model/color and license number.

Guest/Visitor/Invitee duration of the stay shall not exceed two (2) weeks. If the Guest vehicle parking on the street exceeds two (2) weeks, a homeowner may request a variance.  Each variance will be considered individually.

Should a Guest/Visitor/Invitee vehicle remain parked on the street longer than the 14 (fourteen) day period, it will be considered an abandoned vehicle and subject to be towed according to Tamarac CC&R unless a variance and extension is granted from the HOA Board. If not approved for an extension, the Guest must relocate the vehicle outside the Tamarac Community or be subject to towing.   A variance form can be found on Tamarac website:  www.tamaracmv.com

ABANDONED/STORED VEHICLES

Lastly, and in accordance with Section 6.6 of the CC&Rs, abandoned and inoperable vehicles shall not be parked on any Lot or street so as to be visible from the street or neighboring property.  A vehicle parked in the common area must be driven a minimum of once every seven (7) days in order not to be considered stored.  If a vehicle is left in the common area for  longer than fourteen (14) days it will be considered abandoned. Abandoned vehicles will be towed.  Covering of vehicles is not allowed as it gives the appearance of a stored vehicle.  No automobile, truck, mobile home, travel trailer, tent trailer, trailer, camper shell, detached camper, recreational vehicle, boat, or other similar equipment or vehicle may be stored in the garage if it requires a third vehicle to be parked on the street.

Commercial vehicles may not be parked overnight on the street.  All vehicles, either in the garage or parked on the street overnight, must be owned by the homeowner, a tenant of the property, or a homeowner’s registered guest.  Parking is monitored from 11:00 pm to 5:00 am.
