{"id":1438,"date":"2026-05-04T18:20:11","date_gmt":"2026-05-05T01:20:11","guid":{"rendered":"http:\/\/tamaracmv.com\/community\/?page_id=1438"},"modified":"2026-05-04T18:25:27","modified_gmt":"2026-05-05T01:25:27","slug":"parking-fine-policy","status":"publish","type":"page","link":"http:\/\/tamaracmv.com\/community\/parking-fine-policy\/","title":{"rendered":"Parking Fine Policy"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\"><strong>Tamarac at Moon Valley \u2013 Parking Fine Policy<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Parking violations pertain to overnight parking only. Overnight is considered between 10:00 pm and 7:00 am. Violations are defined per Section 6.6 of Tamarac CC&amp;Rs and the Parking Rules and Regulations published on www.tamaracmv.com.  Examples include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Parking on the street overnight if less than two vehicles are stored in the garage<\/li>\n\n\n\n<li>Parking a vehicle on the sidewalk or in a manner that blocks any part of the sidewalk<\/li>\n\n\n\n<li>Parking a vehicle with a storage covering such as a tarp, car cover or other material<\/li>\n\n\n\n<li>Parking a vehicle that is not properly licensed<\/li>\n\n\n\n<li>Parking a vehicle on the street that is oversized or commercially licensed<\/li>\n\n\n\n<li>Visitor Parking of more than three (3) days without proper notice to the HOA or non-compliant with the HOA CC&amp;Rs.<\/li>\n\n\n\n<li>Parking of any RV, Mobile Home, Trailers not in compliance with HOA restrictions for such vehicles<\/li>\n\n\n\n<li>If a vehicle is parked without movement or prior notice to HOA for a period of seven (7) consecutive days, the vehicle will be considered abandoned and will be towed<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Fines &amp; Penalties<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Violation Notice and Response Time Frames:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>1st notice of violation will be considered a courtesy notice and will grant three (3) days to correct violation cause. No fine is issued for 1st violation notice<\/li>\n\n\n\n<li>2nd notice of violation will grant an additional two (2) days to correct violation cause. No fine is issued for 2nd violation notice<\/li>\n\n\n\n<li>3rd notice of violation will result in a towing citation issued with a twenty-four (24) hour compliance time and a fine of $15 per day will be levied. Twenty-four (24) hours after the 3rd notice of violation if the vehicle remains parked on the street, the vehicle will be towed at the Homeowner\u2019s expense.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Fines and Assessment Time Frames:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>No fines during the initial notice periods (days 1-5)<\/li>\n\n\n\n<li>Fines begin on day six (6). A fine of $15 per day will be levied until the vehicle is removed or stored properly in the garage or the vehicle is towed<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Collection<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Without payment of fines or parking resolution, a lien will be issued against the property to which the vehicle is registered. In addition, the Association can retain counsel for collection. All such costs associated with this action will be the responsibility of the Property Owner in violation. The Association may alternatively choose to file a lawsuit in the proper justice court to obtain a personal judgement against the owner. This judgement may then be recorded with the Arizona Maricopa County Recorder\u2019s Office. This judgement lien may then be foreclosed in the same manner as an assessment lien. The Owner will lose all voting rights until the balance is paid in full. Any &amp; all costs associated with the collection of past due fines &amp; penalties, costs, attorney fees &amp; other charges will be assessed to the Owner\u2019s lot. (AZ Statute 35-18)<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Right to Appeal<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">All HOA AZ Homeowners have due process rights for an alleged violation notice.
